摘　　要：违约行为有的是由于合同当事人的原因造成的,有的则是由于合同当事人之外第三人的原因造成的,而后一种情况又使违约责任复杂起来。本文旨在通过对导致违约行为发生的“第三人”概念的界定、合同相对性理论的探讨及侵害债权等问题的研究,从法理上区分第三人原因违约的情况及其责任的承担。Some of the behaviours of violating contracts should be due to the party concerned, others to the third party. And the latter complicated the duty of violating contracts. The article try to define the concept of the third party causing behaviours of violating contracts, inquire into the theory of contract relativity and reach the issue of encroaching on creditor ' s rights .
