摘　　要：按照刑法学界的通说,不作为的成立要满足三个条件:有作为义务,有条件履行作为义务,没有履行。本文以"以假枪冒充真枪上交"为例,以不作为的行为评价中的"对抗性"为立足点,分析何谓"没有履行",即何谓法所期待的行为。According to the criminal law educational world said, the establishment of negative act to satisfy three conditions: be obliged, as have conditions to perform the duty of a failed to fulfill. Based on the "fake gun as real gun due" as an example, with negative act "confrontational" as the foothold, in the evaluation of the behavior of the analysis of what is meant by "not fulfilled", namely, what is the method the expected behavior.
