摘　　要：通过研究国内外司法实践中未出生者的民法地位 ,提出了我国民法典立法中未出生者民法地位的立法建议。Through studying the civil position of unborn children in the domestic and international judicial practice, puts forward the legislative proposal about civil position of unborn children while legislating in my civil code.
