行政合同特权探析

摘　　要：行政合同特权是行政合同的一个重要内容 ,它基于行政合同的行政性以及公共利益优位理念而产生。无论是国外还是国内 ,理论抑或实践 ,行政合同特权都是现实存在的。平衡行政合同特权 ,回归“合同”性质是行政合同特权与契约精神碰撞与协调的归宿。Privilege of administrative contract is an important component of administrative contract, which basic theory is administrative character and concept on priority of public interest. Privilege of administrative contract is realistic in domestic or overseas, theory or practice. To balance privilege of administrative contract and return nature of contract is a destination of conflicting and harmonizing between privilege of administrative contract and spirit of contract. Thorough studying on privilege of administrative contract is helpful for establishing system of administrative contract and legislation of administrative contract.
