举证责任倒置给医院带来新的挑战

摘　　要：“因医疗行为引起的侵权诉讼,由医疗机构就医疗行为与损害结果之间不存在因果关系及不存在医疗过错承担举证责任。”即“举证倒置”,《规定》对医疗侵权既适用过错推定又适用因果关系推定,这种做法过重地增加了医疗机构的举证责任。给医院带来严峻的挑战。文章既强调了病人的权利,也强化了医务人员的证据意识,并面对新规则,指出了医院的应对措施。For lawsuit caused by medical behavior, medical insdtution should be responsible for citing proof to show that there is no causality between medical behavior and harmful result and there is no medical error .' Namely, 'inversion of responsibility for proof citation'. For medical tort, the<Regulation>is suitable to both error inference and causality inference, the measure adds too heavily responsibility for proof citation to medical institution. It is a serious challenge to hospital. The article emphasizes the right of patient and also intensifies the sense of proof citation of medical workers. It points out the measures for hospital to respond the new regulation.
