摘　　要：“依法治国” ,已成为国人共识 ;程序 ,以其强烈的法治气息为学界推崇。在西方国家 ,程序作为国家和公民的“契约”最终确立 ,实在是资本主义私法中契约观念、权利主导意识深入人心的逻辑结果。在我国 ,法治建设将在权利意识较弱。Law-government' has become the common sense of the whole nation. The procedure, with its strong sense of 'rule by law', has been highly praised by the academic circles. In western countries, the idea of procedure, set up as the 'contract' between the government and citizens, was a logical result from the capitalist contract concept and power-oriented idea deeply rooted in the heart of people. In China, the 'rule by law' will become a main feature in an environment of ignorance of rights and strong power orientation.
