摘　　要：在医疗侵权的案件中不乏因输血致患者感染而引起的纠纷,人们有很多误解,故笔者就相关问题作以探讨。作者从血液的法律属性、对输血致患者感染的归责原则以及举证责任问题进行深入探讨,并提出转移风险是避免因输血致患者感染风险的惟一合理的方法,国内应尽早建立完善的专项输血风险补偿基金或输血意外险种。Some medical malpractice is a result of blood filtering.Blood filtering is not only very important but also very dangerous for patient.The point of view of people about medical dissension due to blood filtering is wholly misconceived.In this paper we will discuss some legal problem about medical dissension due to blood filtering.At last the author considers establishing specifical fund and insurance as soon as possible is most effectively in China.
