摘　　要：婚姻登记行为具有私法与公法的双重性质,既是民事行为,又是行政确认行为。婚姻登记行为的双重性质决定了其会产生不同的法律效力;同时对瑕疵婚姻登记的效力认定需要分情况对待,一方面其不影响对于第三人的公示力和证明效力,另一方面对于在婚姻双方当事人间产生的效力应有条件的承认;最后应区分由当事人原因或由婚姻登记机关原因造成的瑕疵婚姻登记,并产生相对应的法律救济途径。The marriage registration behavior has the dual nature of private law and public law. It is not only a civil action,but also an administrative confirmation behavior. The dual nature of marriage registration action determines that it will produce different legal effect. Besides,the effect of the registration defect should be dealt upon difference situations. On the one hand,it doesn't affect publicity force and proof of effectiveness for the third party,on the other hand,the effect between the marriage parties should be recognized under the circumstance. Finally,the reason of the marriage registration defect should be distinguished from the marriage parties or the marriage registration office and generates the corresponding legal remedies.
