摘 要:在欧盟反倾销法中,“非市场经济”问题始终是困扰中国出口企业的最大难题之一。欧盟对华反倾销中的替代国标准、倾销幅度的认定等存在着较大的随意性,对中国出口企业构成了歧视并严重阻碍了中国对欧贸易。本文对欧盟“非市场经济”待遇的产生、变化规律及造成的后果进行了分析和探讨。文章首先介绍欧盟反倾销法的法律渊源以及“非市场经济”问题在欧盟反倾销法中的产生及演变过程;进而结合相关案例,分析欧盟“非市场经济”待遇的适用后果,包括替代国制度、非市场经济国家出口产品正常价值的计算、“一国一税”及其例外等;文章最后就欧盟对华“非市场经济”待遇进行了基本评估,并提出了我国政府与企业的应对策略。只要我国政府与企业充分利用欧盟反倾销条例中的新规定,采取有效措施积极应对欧盟反倾销指控,就可以争取有利的应诉结果。Non market economy 'rule has always been one of the difficult issues to Chinese export enterprises when facing the anti-dumping actions of the EU against China. Since discretion exists in the selection of the 'analogue country 'and the calculation of dumping margin in the EU Anti-dumping Law, it constitutes discrimination to Chinese enterprises and sets obstacles to Chinese export to the European U-nion. This paper examines the origin of the Anti-dumping law,the development and the results of 'non market economy 'rule in the EU Anti-dumping law, including the rule of 'analogue country' ,the standard of the value of goods from non-market-economy country,taxation for different countries,as well as the principle of exception. And based these, it suggests that in order to be treated as a market economy, Chinese government and enterprise should make full use of the new EU Anti-dumping Regulation and take active measures when dealing with the EU' anti-dumping charge.
