摘　　要：本文从我国现行刑法中刑罚结构的失衡及刑事政策性规范的虚置论述移植辩诉交易制度的合理性,并就辩诉交易制度的本土化问题进行了探　　索。This paper expounds the rationality of the system from two angles: unbalance in criminal penalty structure and empty shell of criminal polily code, and also discusses localization of the plea agreement system.
