摘　　要：为正确贯彻执行食品卫生法律法规 ,通过一起行政诉讼案说明取缔是一种行政强制措施 ,不是行政处罚。阐述了强制措施与行政处罚的关系。该分析有助于食品卫生监督员正确运用行政强制措施。In order to implement the legislation and regulation on food hygiene correctly,its is explained that the action of ban is a administrative compelling measure rather than a administrative penalty.The difference between compelling measure and administrative penalty was discussed.The discussion is useful for food hygiene inspection.
