摘　　要：通过分析与比较中国与外国民法中关于法人及医疗机构的分类方法,讨论我国目前对医疗机构法人地位认定及分类的不当之处,继而提出应该在民法中明确医院的法人地位并且提出分类原则。By analyzing and comparing relevant clauses within the civil laws of home and abroad about the legal person and the classification of medical institutions,the author discussed the inappropriateness of the cognizance of legal person status and the classification of medical institutions,and put forward that it should further clarify the legal status of hospital in the civil law and also put forward the principal of classification of medical institutions.
