体育行政执法的权力来源与范围——对“体育行政部门被授予体育行政执法主体资格”的探析

摘　　要：通过相关法学理论,对“体育行政部门被政府法制部门授予体育行政执法主体资格”的说法进行了分析,认为体育行政执法是国家体育行政机关的基本职能,体育行政执法的权力和范围具有法定性,任何机构不具有对行政部门赋予行政执法主体资格的权能,并对体育行政执法权行使中的一些现实矛盾及原因进行了探讨。The authors discussed the issue that'sport administrative department was conferred qualification of sport administrative enforcement sub-ject by government legal department '.They think sport administrative enforcement is the basic function of national sport administrative organiza-tion.And the power and limits of sport administrative enforcement has the nature of legal,any organization has not the power and function to award qualification of administrative enforcement subject.This study also probed into some contradiction and their contributing factors in the sport administrative power exercising.
