摘　　要：　古代文人小说充分利用了自己介于国家与民间的中间地位,在向民间社会解说和诠释自己心目中的国家法律秩序时,意外地重构了一个与国家法律秩序有较大出入的民间法律秩序。The author argues tha t Ch inese ancient stories have played an important role in reconstructing the legal order of non-goverment state in rural and municipal communities. In ancient time s, the populace has no access to education, and the novels are the best entertai nments. As the citizens and peasants listen to the stories, they accept what the y are told. Therefore, the stories created the legal order in Chinese ancient to wns and villages.
