摘　　要：通过对目前旅游和建筑行业经营方式的考察和对经营中的挂靠形式和挂靠行为的分析,指出挂靠经营行为具有法律关系上的复杂性,应当划分为一体型、相对独立型和完全独立型三种类型分别进行处理。An investigation on the forms of operation in the fields of tourism and architecture and forms of private business in the name of companies indicates that private business acts in the name of companies are legally complicated and should be dealt with in three kinds: act as an organic whole, relatively independent act and absolutely independent act.
