台湾共同抵押制度及其借鉴

摘　　要：共同抵押制度是一种特殊的抵押制度。在现代社会 ,该制度对于资金融通与经济发展的作用不容忽视。在台湾 ,该制度已实施多年 ,无论是在理论上 ,还是实务中均有其值得借鉴之处。文章以台湾有关共同抵押制度之立法、理论和实务为依据 ,探讨了该制度的特征和性质、成立与效力等问题 ,并依此分析了大陆关于该制度的规定及其功过得失。Joint mortagage system is a special guaranty. In modern times, its effect on financing and economy developing is unassailable. This system has carried out for many years in Taiwan. Whether in theory or in practice, we have something to study. According to its legislation, theories and practice in Taiwan, we discussed its characters, creating and effectiveness, then analyzed the provisions and merit in our law-system.
