药品监督执法中查封、扣押与先行登记保存的比较分析

摘　　要：本文从法律依据、适用条件、适用目的、救济途径等方面,将查封、扣押与先行登记保存作了比较分析,并对工作中存在的一些模糊认识以及法律法规应进一步完善之处进行了探讨,提出相关建议。To seal up or to distrain suspicious substances by legal authority should be used differ from antecedent register to assure the safety of evidences. Although these two measures are similar in some aspects, which often make drug supervisor confused. To seal up or to distrain is according to Drug Administration Law and Regulations for the Supervision and Administration of Medical Devices, which in order to prevent people from false and inferior drugs and medical devices, while antecedent registering to assure the safety of legal evidences in according to the Administrative Punishment Law to stop the legal evidences to be lost. Other differences of the two measures are analyzed in this article , so drug supervisor should handle them carefully and use them properly.
