摘　　要：文章通过新刑法所体现的价值取向的评析,结合我国法律传统和现实,提出实现刑法法治化所应采取的人权保障优先的刑法思想.并结合司法实践,从刑事司法程序、定罪量刑和刑罚的执行等几个方面来论述当面对刑法价值的冲突时如何做出两难的选择.The article first comments the value of China criminal law in 1997.Then according to the legal tradition and reality in China, thinks that China should choose the ideology of criminal law that human rights take precedence over all others in order to realize rule by law. The article lastly discusses how to make a choice in a dilemma in the face of the value conflict in judicatory practice through criminal judicatory procedure, conviction and measurement of penalty, penal execution and so on.
