美国体育法学发展及对中国的启示

摘　　要：美国法学院的体育法教学研究始于20世纪70年代,快速发展于20世纪90年代,目前已进入平稳发展期。体育法在发展源于社会需求:美国的职业体育、大学体育和大众体育的发展,使体育领域成为一个商业领域,吸引着法学院师生投身其中;体育法是美国体育管理专业学生的必修课,侧重于侵权法、产品责任、过失、风险管理等体育伤害相关问题,以帮助学生应对工作中的体育伤害问题。通过对美国体育法文献的统计可知,美国体育法研究的主要问题有体育平等参与和反歧视、大学体育、职业体育、反垄断、运动员合同与劳资关系、体育代理、知识产权、转播权、体育伤害与侵权、兴奋剂、赌博、体育暴力、体育场馆、税收、纠纷解决与仲裁、奥林匹克与国际体育法等问题。美国体育法研究有紧跟体育发展,关注本土问题,以案例为中心的特点。For law schools in United States,sports law courses taught by full-time faculty occurred on the late 1970 sand rapidly developed in 1990 s.Today,law professors are interested in teaching and writing in the sports law area,as well as students are interested in studying it.These developments suggest at least three reasons why law schools should embrace the study of sports law,including students interest,the public's need for law schools and the need of teaching in law schools.For students major in sports management,the legal aspects of sport is recognized as a separate content area within the sports management core curriculum standards(NASPE,2000),and focus on torts,product liability,negligence,risk management strategies to help students release from the legal liability from sports injuries.By studying the topical bibliography of legal resources in sports law,this article suggested that the field of sports law has moved beyond the traditional antitrust and labor law boundaries into gender,race and disability equity in sports;high school and collegiate athletics;professional athletics;sports representation and legal ethics;copyright,broadcasting and licensing;sports injuries,sports violence,participant and spectator liability;doping;gambling;stadium and franchise;alternative dispute resolution;sports and taxation;Olympic and international issues in sports law and other permutations.The research of sports law in United States focus on the national issues with the time,and the sports issues related to state laws,not sports rules.
