市民社会与政治国家互动——入世背景下中国法治道路模式

摘　　要：入世促进中国市场经济体制的完善,将催生成熟的市民社会,这铺垫了法治的基石;入世促使中国政治体制的完善,将架构规范的政治国家,这指向了法治的核心。在入世的背景下,在外部力量的冲击和内部力量的涌动下,中国的市民社会与政治国家趋于成熟与完善,并且两者之间形成了良性的互动关系——即两者之间既是对立的,也是统一的;既是对抗的,也是合作的;既是制衡的,也是配合的。入世推动市民社会和政治国家这两个轮子互动前进,中国将在这种背景下步入法治之路,走向宪政之巅。Entering WTO perfects China's market economy system, which will catal yze mature civil society that is the footstone of rule of law. Entering WTO perf ects China political system, which will set up normative political state that is the core of rule of law. In the context of entering the WTO, there is not only the shock of exterior force, but also the upsurge of interior force, by which th e civil society and political state become mature and normative. Furthermore, wh ich engender benign interacting relation--not only opposing but also unifying, not only counteracing but also cooperating, not only checking but also collabor ating. The two wheels of the civil society and political state advance together, which will make China realize rule of law and set up constitutional government.
