摘　　要：电信企业单方调整电信资费 ,导致多数用户资费增加。虽然电信合同具有合同的一般性特征但具有特殊性 ,尽管电信企业不存在违约 ,但还存在收取电信资费的法理依据不够充分以及明确标准调整权的归属等问题 ,因此 ,需要纳入法治化轨道才能保障其公众合法权益。The unilateral charge adjustment of China Telecom leads to the charge increase of most users. Though telecom enterprises did not breach of faith, there existed some questions such as inefficient law basis on communication charge and the adjusting authority of definite standard because contract signed by telecom and users has the same characteristics as normal contract. Therefore, the situation requires government change its actions compatible with the on-going circumferences, making the telecom charge management legitimate in the interest of the public.
