意大利非法证据排除规则对我国的立法借鉴

摘　　要：非法证据的排除规则是证据法中的一项重要规则,作为融大陆法与英美法为一体的意大利法,其证据法中的非法证据排除规则采用了强制排除模式,即强调法定排除原则,法官无自由裁决权。这项规则有利于防止在法制化进程中司法的武断和侵害人权,对我国证据立法有一定借鉴作用。The coercive abatement of illegal evidence is an important rule in evidential law. As a combination of the Continental Law and the BritishAmerican Law, the Italian Law adopts the mode of coercive abatement, i.e., they emphasize the rule of legal abatement, and the judges have no free power of adjudication. This rule can help to prevent the judicial arbitrariness and the violation of human rights in the procedure of legalization , and we can take it as a reference for our country's evidential legislation. 
