侦查阶段辩护律师的诉讼地位浅议

摘　　要：刑事案件中律师在侦查阶段的诉讼地位在我国刑事诉讼法中没有明确的规定 ,理论上对这一问题的认识也不一致。本文从控辩平等原则出发 ,认为辩护律师在侦查阶段主要是帮助犯罪嫌疑人行使辩护权并监督制约侦查机关的活动 ,维护犯罪嫌疑人人权的重要作用。The paper,from criminatively equal principle,holds that the function of defe nse counsels' is to enable the suspects' right to defense,to supervise the activ ities of investigatioinal organs and to defend the suspects' human right at the stage of investigation.
