科学数据共享法规体系建设的若干思考

摘　　要：本文试图通过法理分析 ,探讨科学数据共享法规体系建设的指导思想、原则、工作思路 ,提出了科学数据共享过程中需要法律调整的 4个关键问题 ,即 :从法律上协调科学数据同时作为社会公有物品和市场商品两者之间的关系 ;协调和界定知识产权保护范围和社会公共功能范围 ;确定和调整共享过程中当事各方之间、以权利和义务为内容的各种社会关系 ;Based on the background of govern\|country\|by\|law and juristic analyses, the guidelines, principles, and working schema on the construction of the legal framework for scientific data\|sharing are discussed, and four key issues, which need to be legally adjusted in the process of scientific data\|sharing, are put forward. Specifically, these include: legally coordinating the relationship between the public\|owned property and the privately\|owned commodity of the scientific data; coordinating and delimiting the scopes for knowledge property protection and for social public functions; determining and adjusting a variety of social relations in the person of rights and obligations between every party during the process of data\|sharing; and establishing the status of the scientific data\|sharing technology.
