摘　　要：科技成果转化法以促进科技进步及成果转化为立法目的,但却在科技成果转化主体的功能定位上存在明显立法偏差,难以发挥法律对科技成果转化主体的立法保障作用。分析科技成果转化立法与实践的差异,调整立法偏差,将会有助于促进科技成果转化法的有效实施。The legislative intent of Law of Transformation of Scientific and Technological Achievements is to promote scientific and technological progress and achievement transformation. However, there is distinct legislative warp with respect to the functional orientation of scientific achievement transformation subject. Analyzing the difference between Law of Transformation of Scientific and Technological Achievements and practices and correcting the legislative warp of scientific subject will be benefit to the efficient implement of Law of Transformation of Scientific and Technological Achievements.
