摘 要:不动产登记制度是物权法的重点内容,从比较法的角度看,我国不动产登记制度存在着法律依据不统一、登记机关不统一、登记的权利和地域范围过于狭窄、登记是否具有公信力不明确、登记只是形式的审查以及未建立登记机关的责任赔偿制度等弊端,必须在法制统一的基础上进行完善,即建立统一的登记机关、扩大登记的权利和地域范围、赋予登记以公信力、建立实质审查制度和登记机关的责任赔偿制度。Realty registration system is the essential content of law of property.From the Comparative Law' s point of view, there exist the following defects in the realty registration system in our country: the disunity of legal basis and the registration office, the straitness of registration rights and regional scope, the uncertainty of registration' s public reliance, and the facts that the registration is just examined formally, and the restitution liability system has not been set up ect.Thus we should perfect it on the ground of legal unification, set up united registry, enlarge registration rights and regional scope, give registration public reliance, set up material examination system and the registries' restitution liability system.
