摘　　要：海上保险中的适航性问题历久为众家瞩目 ,而近几年我国发生的几起大宗船损、货损索赔案都牵涉船舶的适航性在海上保险中的评价 ① ,但因我国相关法律对此关注不够而导致司法实践尚未尽如人意 ,故笔者在界定船舶适航性的定义及标准的基础上着重探讨了适航性在海上保险中的相关问题 ,包括适航性在航次保单和定期保单中的应用时间、应用范围。The seaworthiness related in marine insurance has drawn the attention from the operators in the related fields for a long time,and during the past several years, there occurred several complex cases, about the damage of ships and goods, that relate to ship seaworthiness, however the related laws of our country have fewer regulations about the problems of seaworthiness, especially the seaworthiness in marine insurance,and the judicial practice is unsatisfied sometimes. So the author gives the ideas about the application of seaworthiness in marine insurance with the wishes to settle them properly, including the time and the range applied in voyage policy and time policy, the assumption of onus probandi and the law results about the violation of seaworthiness, etc.
