论定罪三段论及其在法庭审判中的作用

摘　　要：在审判工作中,不能把定罪三段论视为一般三段论,定罪三段论是在审判工作的思维实践中总结出一种新的推理形式,定罪三段论在审判工作中具有重要作用。In the lawcourt trials,syllogism in conviction should not be equated to the syllogism in the common sense. Syllogism in conviction has been elicited from the practical trials and reflects the thinking process of the lawyers in convictions,and teerefore it is playing a very important part in the lawcourt trials.
