对我国产品责任制度的几点思考

摘　　要：在我国加入WTO和建立社会主义市场经济的条件下,产品责任制度将起着越来越重要的作用。文章根据产品责任理论的发展和国外产品责任的经验,分析了我国目前产品责任制度存在的一些问题,如缺陷的认定、供应商的产品责任、贴牌制造商(OEM)的产品责任、企业法人变更后的产品责任和防撞性缺陷责任等,以期对我国产品责任制度的发展有所裨益。With the entry of China into WTO and the development of socialist marketing economy in China, product liability system is going to play a more and more important role. Based on the development of product liability theory and the experience of foreign countries, the paper analyses some problems in Chinese product liability system, including defect identification, product liability of suppliers, OEM (original equipment manufacturers) and successors, and the defect liability of crashworthiness etc. The analysis is to benefit the future development of product liability system in China.
