摘　　要：制约农民问题的关键是建国以来所实行的城乡分治政策和体制。我国农村改革忽视了对传统经济体制和政治体制的冲击,市场对农村资源不能起基础性配置作用。农民的非国民待遇,造成宪法规定的公民权利和自由得不到落实和尊重,农民在经济上的不独立,以及与基层政府的利益矛盾日益加剧,导致农村的民主机制不能保证农民的合法权益。The key factor restricting farmers problems is the policy and system governing city and countryside separately which has been carried out since the foundation of China The reform in our countryside neglects the pounding at the political and economic system and the pounding at the political and economic system and the market cannot function as the basic distribution of resources As a result of farmers non-national treatment, the citizens rights and freedom cannot be fulfilled which are stipulated in the constitution, Farmers are not economically independent and the conflict of interests between farmers and grass-roots governments is worsen, the democratic system in the countryside cannot guarantee farmers legal interests 
