摘　　要：(续《仲裁研究》第四十二辑)四、保护伞条款保护伞条款,是指在双边投资协定中规定缔约一方应遵守其对缔约另一方投资者所做特定承诺的条款。在本案中主要涉及瑞士—乌拉圭BIT第11条。该条标题为'遵守承诺',规定:每一缔约方应当持续性地保证遵守其对其他缔约方的投资者所作的承诺。(一)对于非标准保护伞条款的理解瑞士—乌拉圭BIT第1 1条的用语和标准的保护伞条款有所不同.There is a long-term widely spread rumor,which says the arbitration was biased to the host state in the international investment dispute settlement.In 8 July,ICSID Arbitration issued its reward,which makes the host state Uruguay win all the point in the legal battle.This research discussed the expropriation,the fair and equitable treatment,the umbrella clause,the denial of justice and the amicus curiae issue relating to the measures at issue in order to analyze the improperly believed rumor.Besides,this research offers some comments on the reward from perspectives of both international law,namely treaty interpretation,and China’s standing.
