法律生态化理念下的绿色专利制度浅析

摘　　要：伴随生态环境的不断恶化,各个国家越来越重视对环境的保护和污染的治理,推出相应的治理办法与制度改革,希望通过政治、经济、法律、技术、等综合手段解决环境问题的呼声变得越来越高。由于技术在环境保护中发挥重要作用,由此也催生了大量关于像科技发展与环境伦理、专利法生态化以及绿色专利制度的研究与讨论。我国由此提出了法律生态化的理念。本文以其中最为突出的绿色专利快速审查制度为例,通过对近几年绿色专利成果的调研,分析该制度所带来的利弊;同时将西方该具体制度与我国比较,并提出建议以完善相关立法。以此,对法律生态化理念指导下的制度运行提供理论借鉴与现实指导。With the continuous deterioration of the ecological environment, more and more attention is paid to the environmental protection and pollution control. Many countries put forward methods and the corresponding system to solve the environmental problems by means of political, economic and legal,technology, etc. Because of the important role of technology in the protection of ecological environment, there are a large number of research and discussion on the development of science and technology and environmental ethics, the ecological law, the system of green patent. Many scholars in our country put forward the idea of ecological law. In this paper, we take one of the most prominent systems as an example---green patent rapid examination system. Through the investigation of green patent achievements in recent years, we analyze the advantages and disadvantages of the system. At the same time, we compare the Chinese system with the Western systems and put forward some suggestions to improve the relevant legislation. In this way can we provide theoretical reference and practical guidance for the operation of the system under the guidance of the concept of ecological law.
