摘  要:在全球化和区域一体化的进程中,宪法与国际法的相互作用和相互影响,成为法学发展的显著特征,出现了宪法概念从宪法学向国际法学的移植,宪法为国际法的发展提供了方法论的启发和灵感,形成了国际法宪法化的解释和建构思路,使宪法理念融入国际法制建构,为宪法学参与全球治理的法制建设打开了大门。国际法特别是国际人权法推动了宪法权利法案的制定和权利清单的完善,国际法及其判例成为国内宪法裁判的解释性资源,在宪法判决中得到援引和使用。在欧洲一体化进程中,还形成了基本权利保护的宪法与国际法双层架构,出现"合宪性审查"与"合公约性审查"并存与竞争的局面。In the process of globalization and regional integration, the interaction and influence between the Constitution and international law has become a remarkable feature of the development of law, and the concept of Constitution has been transplanted from constitutional law to international law. The Constitution provides the methodological enlightenment and inspiration for the development of international law, forms the idea of interpretation and construction for the constitutionalization of international law, integrates the constitutional idea into the construction of international legal system, and opens the door for the constitutional law to participate in the legal construction of global governance. International law, in particular international human rights law, has promoted the enactment of the constitutional bill of rights and the improvement of the list of rights, and international law and its legal precedent have become interpretive resources for the domestic constitution judgment and have been cited and used in constitutional decisions. In the process of European integration, a two-tier framework of Constitution and international law for the protection of fundamental rights has been formed, and the coexistence and competition between constitutionality review and conventionality review has emerged.
