摘  要:在《海商法》修订的过程中,是否将内河运输纳入《海商法》的适用范围成了争论的热点。支持者认为,由于民法对内河运输调整不具有针对性,司法解释也很难进行大面积的法律漏洞的补充,《水路货物运输规则》也很难作为航运习惯予以适用,因此,应考虑以专章的形式将内河运输有关的法律规则规定在《海商法》中,以适应航运中司法实践的需要。In the process of amending the China Maritime Code( CMC),whether inland waterway transport should be included in the scope of application of the CMC has become a hot topic of debate. Supporters believe that: Firstly,the civil law has no pertinence to the adjustment of inland waterway transportation. Secondly,judicial interpretation is also difficult to take on the supplement of a large area of legal loopholes. Thirdly,the rules of the domestic carriage of goods by water are also difficult to apply as a shipping custom. Therefore,a special chapter should be considered to incoporate the relevant laws and regulations of inland waterway transport in the CMC so as to meet the needs of judicial practice of shipping.
