摘　　要：期刊社与作者之间的关系是一种法律关系,这种法律关系具体体现为双方的合同关系,期刊社与作者在这种法律关系中拥有不同的权利、义务及法律责任。只有在明确期刊社法律地位的基础上,才能更好地保护期刊社和作者双方的权利。The law relationships between the journal bureaus and authors were analyzed in this paper. It was thought that the law relationships were showed the contracts of the both sides virtually. With analysis of rights, duties and the law responsibilities of the journal bureaus and authors, it was thought that only when the law position of journal bureaus was clear and definite, could the rights of the journal bureaus and authors be protected.
