摘　　要：理论界关于法人的本质问题、法人是否具备犯罪能力及法人是否有承担刑事责任的能力 ,一直存在争论。笔者认为法人是客观存在的 ,并具备犯罪能力和刑事责任能力 ,本文分别对此阐述了具体的理由。Theoretically, there has been much dispute over the question that whether corporation is impersonal or not,and whether corporation has capacity to undertake criminal responsibility or not. The author holds the opinion that corporation can commit crimes and take on criminal capacity.
