摘　　要：惩罚性赔偿责任制度有两种主要具体表现形式:惩罚性赔偿条款、精神损害赔偿。惩罚性赔偿责任制度的价值在于:在自由的市场经济中追求实质的社会正义,并尝试能完善经济法的责任理论,以发展中国本色的法律理论。The system of punitive damages mainly has two concrete forms: punitive damages and, spirit damages. The value of the system of the punitive damages lies in pursuing the virtual social justice in the free market economy, and accelerating the development of Chinese characteristic legal theory by consummating the obligation theory of infringing the economic law.
