摘　　要：社会主义市场经济是平等经济 ,它要求的法律面前人人平等原则不仅指刑罚适用上的平等 ,更应成为刑事立法的基本指导思想 。The socialist market economy is an equal economy, which is based on the principle that anyone is equal under law. This principle should be not only the equality applied to anyone who commits a crime, but also the guiding idea of criminal legislation. We should perfect criminal legislation under the guiding of the principle of equality.
