摘　　要：行政自由裁量权的合理运用是行政法治的必然产物 ,并且反作用于行政管理。但是因为行政自由裁量本身固有的特性 ,使其在发挥积极作用时 ,又不可避免地会出现这样或那样的问题。由此 ,本文提出要从事前事后两个方面对行政自由裁量权予以控制 ,并且对目前我国行政法在这一方面存在的问题提出了一些解决方法。The right of Administrative Discretion is the inevitable production of administrative constitution and itcan react on administrative management.But because the inherent characteristic of Administraive Discretion,when it plays its active role,many possible problems may arise inevitably.This paper intends to demonstrate some methods to control the Right both before and after the litigation .The paper also offers the resolutions to the problems,which occur in our existing administrative law.
