On the Liability of Netnews Tort

摘　　要：网络新闻侵权是由用户在BBS上发布不当网络新闻引起的特殊侵权行为。在用户IP无法查询的情况下,鉴于ISP具有"事后编辑功能",应由其承担替代责任,并适用过错推定原则,免责事由除适用传统传媒新闻的免责事由外,还应有其特定的免责事由:即在"合理的时间"内按"表面合理标准"对网络新闻进行审查、编辑、删节,可"减轻或免除责任"。Netnews tort is a special conduct of tort caused by the issuance of improper Netnews on the BBS by users. In case that the IP address of users cannot be queried, ISP should take on the vicarious liability because of the'subsequent editing function' of ISP, for which the principle of fault presumption is also suitable. Besides ISP's excuse of nonresponsibility is suitable for the news of traditional media, it should also have their special certain kind of excuse of nonresponsibility: that is, they should censor, edit and abridge the Netnews at a'reasonable time'in terms of'superficially reasonable criterion'so that to'mitigate or exempt from liability'.
