摘　　要：代理是一项重要的民事法律制度。随着商品经济的快速发展,各种市场主体对代理的要求越来越高。目前我国的代理立法已不能适应各种代理事务的需要,因此补充和完善代理制度迫在眉睫。本文主要从我国代理制度的立法特点、立法不足、引进隐名代理以及完善无权代理等几个方面进行探讨。Agent system is an important civil legal system. With the rapid development of market-oriented economy, the demands of various market subjects on agents are becoming increasingly higher. Our present agency legislation cannot meet the requirements of kinds of agent affairs. As a result, it's urgent that the a-gent system should be improved and perfected. This paper makes a major probe into the agent system in China from such aspects as the legislative characteristics, inadequacy of legislation, introduction of undisclosed agent and perfection of ex agency.
