略论虐待罪对象之家庭成员

摘　　要：　作为虐待罪的对象,"家庭成员"是范围相对开放的概念,其认定应当以家庭组成的实际状况为依据。在不同的视角下看,被虐待的家庭成员具有如下典型特征:1.对虐待行为人的依赖性;2.所承载价值的冲突性;3.在犯罪成立和追诉中的能动性。家庭雇员在特殊情况下可以成为虐待罪的对象,虐待被买妇女、儿童的行为不能定虐待罪。Family members is a conception of relatively open category. As a target of maltreatment, they should be identified in arccord with the actual states of famaily components .From different views, family members must have the following features:1.the dependence on the member having a behavior of maltreatwent; 2.in conflict with possessory value;3.the dynamism in the course of convicting and retroacting the crime. Hire labors may turn into the targets of maltreatment under special circumstances. Maltreating the purchased women and children can not be convicted as maltreatment.
