工程款优先受偿权相关各方权利的法律地位比较研究

摘　　要：通过研究《最高人民法院关于审理建设工程施工合同纠纷案件适用法律若干问题的解释(征求意见稿)》中关于工程款优先受偿权的规定,分析购房人、银行、承包人以及分包商等与工程款优先权有关各方的权利在法律地位上的对比变化,指出购房人的生存权得到进一步巩固,银行的抵押权获得了扭转性的有利保障,承包人的工程款优先受偿权受到了更大的限制,分承包人行使代位权难度很大。对工程款优先权可能受到的各种不利影响进行分析,对完善有关条款提出修改建议,并指出司法解释应当体现合同法立法本意,切实起到保护承包人合法权益的积极作用。By researching the Judicial Explanation to be issued by the Supreme Court on how to judge the disputation about the construction project contract, analyzing the comparatively change among the legal positions of rights related to the priority of the payment for construction of project. Indicating that the rights of purchasers will be strengthened, the hypothec of banks will be guaranteed, the rights of contractors will be restricted and the rights of subcontractors will be difficult to be exerted. And the Judicial Explanation should conform to the Contract Law so that it can have the positive effect on protecting the contractors' legal privilege.
