摘　　要：在当代的宪政制度发展中违宪审查制度起着有效地解决宪法规范与社会现实冲突的重要功能。合宪性推定作为合理地行使违宪审查权的重要原则,为宪法解释者提供了理性判断的依据。文章分析了合宪性推定原则的概念、理论基础与相关判例,并探讨了其功能与局限性。In the development of constitutional system of the time, the constitutional review power plays an important role in effectively resolving the conflicts between constitutional rules and social praxis. Constitutionality presumption, as an important principle to execute the constitutional review power reasonably, provides constitution's interpreter with rational basics of judgement. This paper analyzes the concept, theory basics and interrelated cases of the principle of constitutionality presumption, and explores its function and limitation.
