关于发明专利申请人权利若干问题的思考

摘　　要：从我国现行法律规定来看,在发明专利申请人向专利行政主管部门提交专利申请以后到发明专利申请被授予以前这段期间内,对申请人的相关权利缺乏法律上的充分保障。分析了该相关权利的性质和特点,重点审视了其受侵犯法律救济的不足,认为应当从鼓励技术创新的角度对现行法律规范进行完善,并提出了可操作性立法建议。Invention patent proposer's right isn't propected properly by laws in China at present.After a proposer put in for patent to the State Intellectual Property Office of P.R.C,his/her right isn't ensured enough in the period of waiting for being granted patent.This paper tries to analyse the character and trait of proposer's right, especially scan law's limitation on remediation for it's losing when it is infringed.The paper also put forward maneuverable legislation advices to amend current laws with the view of encouraging innovation.
