对我国司法解释相关法律问题的探究

摘　　要：在我国,司法解释对于法律适用发挥了不可忽视的作用,但个别司法解释与现行法律发生冲突,司法解释与行政法规的规定不一致,甚至各地高级人民法院也对法律适用以“意见”、“会议纪要”等形式作出规定,导致我国司法解释出现了若干问题。笔者通过对上述问题及其消极后果的分析,提出我国解决司法解释相关问题的有效途径,期望我国能够尽快明确司法解释的法律地位,按照“依法办事”的原则,维护法制的统一和尊严,保持法律的严肃性。Judicial explainations play the very important role in laws application in our country. But some judicial explainations clash into some laws in force.Some judicial explainations are not in keeping with some administrative legal provisions.Even each high people's court explains the laws in the form of “opinion”or “summary of meeting”, etc.This leads to some problems in judicial explainations in our country.The writer suggests some effective ways to solve the problems about the judicial explaination in our country through the analysis on the above-mentioned problems and their negative consequences.And the writer hopes our country could define the legal status of judicial explaination as soon as possible,according to the principle of taking action in accordance with the laws so that the unification and dignity of the legal system could be defended ,and the serious nature of laws coule be kept.
