法作为公共意识是如何可能的——现象学的视野

摘　　要：在现象学看来,先验自我构造出来的相互联系着的"我"和"他人"为法作为公共意识的可能打下了基础;而立法者、执法者和守法者之间在历史中、应用中、语言中形成的相互理解最终使作为公共意识的法成为可能。From the perspective of phenomenology, the relationship between Ego and Someone-else constructed by transcendental Ego constitutes the basis of law as public consciousness. The mutual understanding among legislative officials, law enforcement officials and the people who abide by the law makes it possible for law to become public consciousness.
