摘　　要：　沿着解构传统法律文化的进路,讨论当代中国社会法治建设所面临的制度与理念脱节的问题;文章提出以独立的思维,开放的思想,摒祛"本土"与"西化"的争论,将人类一切法律文化成果都看作一种资源,进而探讨建构有中国特色的先进法律文化的出路。Parsing the traditional legal culture, we mainly discuss that the legal system and theoretics do not match. There is a debate between localized pattern and western pattern; Without considering it, we put forward a new pattern on nomocracy construction .In view of an uniform concept, we put all the legal culture together and regard it as a precious resource. In terms of this notion, we concern the solving method on the advanced legal culture construction with distinct Sinitic characters.
