摘　　要：人类基因技术作为一门新兴技术,具有极其可观的商业价值,而它所引发的伦理道德和法律问题也给社会带来很大冲击。从国际立法看,通过对基因技术进行专利保护保护基因资源已成为一种有效的方式。本文运用比较研究方法就基因的可专利性问题进行探讨。The technology of human gene, a newly burgeoned technology,possesses profitable trade value. It also brings forward concussions to the society in ethical and moral issues, and legal issues as well. From the perspective of international legislations, patent protection of gene technology turns out to be a effective method to protect the gene resources. This essay discusses the patent protection of gene technology through comparative studies.
