摘　　要：我国现有国有企业、公司企业、私营企业等多种企业形态 ,国有企业作为国民经济的支柱 ,它的存在是必要和必需的。但国有企业由于立法和执法的原因 ,在生产经营时遇到许多问题 ,以致许多国有企业萎缩和消失。为改变这种状况 ,应尽快修改有关法律、法规 ,加强国有企业的监督机制 ,防止国有资产的流失。The present Chinese enterprises feature different types of ownership w ith state ownership supposedly serving as the pillar of the national economy. Ow ing to legislative and enforcement factors many of the state-owned firms are con fronted with operational difficulties and some of them even vanish or disappear from the market. Relevant legislation and regulation that strengthen the supervi sion of the state-owned enterprises is thus needed to turn the tide and protect the state-owned assets from getting lost.
